These terms govern your use of TopBid (the "Service"), operated by Naitik Varshney. By placing a bid you accept them.

1. What a listing is

Every listing on TopBid is a paid advertisement. Position reflects the amount paid and nothing else. A listing is not a review, a recommendation, an endorsement, a certification, or any statement by us about the quality, safety, legality or performance of what is listed. We do not test, vet or verify listed products beyond the limited checks described in these terms.

2. Bids and ranking

  • Bids are in whole US dollars, minimum $5, maximum $999,999.
  • Taking the #1 position costs at least $5 more than the current highest total. Lower amounts place you at the corresponding rank.
  • Where totals are equal, the earlier payment holds the higher rank.
  • Raising a listing you already own charges only the difference above your current total. Ownership is established by the browser cookie that made the first successful payment.
  • Ranking is dynamic. Your position can and will change as others pay. We make no promise that any position lasts for any length of time.
  • Amounts shown before checkout are indicative. Because other payments may complete while yours is in progress, your payment is placed at the rank it supports at the moment it is recorded, which may be lower than the rank quoted when you began checkout. The full amount is credited to your total in either case. This is not a defect and does not entitle you to a refund.
  • The published rules at /rules form part of these terms.

3. No guarantee of traffic or results

We do not guarantee impressions, clicks, conversions, revenue, search ranking, or any other outcome. Analytics shown in the Service are provided for information and may be approximate.

4. Payment, tax and refunds

Who charges you

Payments are processed by Dodo Payments acting as merchant of record. They — not Naitik Varshney — are the legal seller of the transaction, and their name is what appears on your card statement and invoice. They are responsible for collecting and remitting applicable VAT, GST and sales tax. We never receive or store your card details.

All sales are final

Bids are non-refundable. A bid buys a position on a public leaderboard, and that position is created the moment your payment is confirmed — the service is delivered in full, immediately, and cannot be returned or un-delivered.

By submitting a bid you expressly request that this service begin immediately, and you acknowledge that once it has begun you lose any statutory right of withdrawal or cancellation that would otherwise apply to a distance or online purchase.

In particular, the following are not grounds for a refund:

  • Being outranked, at any point, by anyone paying more. That is the product.
  • Receiving less traffic, attention or revenue than you hoped. We promise no outcome and never have — see section 3.
  • Landing at a lower rank than the one quoted when you began checkout, because another payment was confirmed first. Your money still counts in full toward your total.
  • Changing your mind, or your employer changing theirs.
  • Removal of your listing for breach of section 5.

When we will refund you

A no-refund policy is not a licence to keep money for nothing. If we take a payment and fail to deliver the listing it paid for, we refund it. Specifically:

  • You were charged more than once for the same bid.
  • Your payment was confirmed but no listing or rank was created, and we cannot place it manually. Contact hello@topbidai.com with your receipt and we will resolve it, at our cost, without needing you to pay again.
  • We charged an amount other than the one you were shown at checkout.

The merchant of record has the final say

Because Dodo Payments is the legal seller, their refund and dispute policy governs the payment itself and may allow a refund in circumstances this section does not. Nothing here limits their rights or obligations, or any right you have under mandatory consumer protection law in your country of residence, which cannot be waived by agreement.

Chargebacks

If you believe a charge is wrong, contact us first — we will almost always resolve it faster than your bank can. Raising a chargeback instead may result in the listing being removed immediately and without refund of any remaining balance, and in our declining future bids from you.

5. Content you may not submit

You may not submit a listing that points to, promotes, or facilitates:

  • Sexually explicit or adult content;
  • Malware, phishing, credential harvesting or other deceptive software;
  • Gambling, financial scams, pyramid or Ponzi schemes, or fraudulent offerings;
  • Chat, group, invite or referral links (Discord, Telegram, WhatsApp and similar);
  • Link shorteners or cloaked, disguised or redirect-chained destinations;
  • Content that infringes intellectual property or impersonates another business;
  • Hate speech, harassment, or content targeting a private individual;
  • Anything unlawful in Uttar Pradesh, India or in the visitor's location.

Listings must resolve to a working destination that clearly identifies the company or individual operating it. Destinations that hide operator details may be removed.

6. Our rights over listings

  • We may remove, hide, re-categorize or refuse any listing at our sole discretion, including for breach of section 5, for legal or reputational risk, or on a credible third-party complaint.
  • Removal for breach does not entitle you to a refund, in whole or in part.
  • We may change a listing's displayed name, description, image or category to keep the board accurate and readable.
  • We may correct ranking errors caused by fraud, technical fault, or payment reversal.

7. Third-party names and logos

Names, logos and images shown alongside a listing are the property of their respective owners and are used to identify the listed product — nominative fair use. Their display does not imply affiliation with or endorsement by those owners. If you own a mark shown here and want it removed, contact hello@topbidai.com and we will act promptly.

8. Takedown requests

Send takedown or complaint requests to hello@topbidai.com with the listing URL and the grounds for the request. We review every request and may remove a listing while we do.

9. Liability

The Service is provided "as is". To the maximum extent permitted by law we exclude all implied warranties, and our total liability to you for any claim is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental or consequential loss, including lost profits or lost business. We are not responsible for the products, services, content or conduct of any listed third party. Nothing here excludes liability that cannot lawfully be excluded.

10. Changes

We may update these terms. The version in force is the one published here when you place a bid; material changes will be noted by the date at the top of this page.

11. Governing law

These terms are governed by the laws of Uttar Pradesh, India, and disputes are subject to the exclusive jurisdiction of its courts, without prejudice to mandatory consumer protections in your country of residence.
